Photography Terms and Conditions

Please read the below important information – it covers both me and you:

  1. The Photographer(s) will document the events in a candid manner and take formal portraits as necessary. The client should provide a full list of formal photographs required including names and relationship to the client.
  2. Prior to or during the event, the Client may inform the photographer of subjects which they would like photographed, but the final content of the images is at the discretion of the Photographer.
  3. The Client will ensure that the guests at the event do not interfere with the photographer’s work.
  4. When using digital photography, the Photographer(s) will be under no obligation to display the images while the event is still underway.
  5. The Photographer retains the copyright to the images.
  6. If the Photographer is unable to perform due to fire or other casualty, strike, or other cause beyond the control of the parties, or due to the Photographer’s illness or injury, then the Photographer shall return the deposit to the Client but shall have no further liability with respect to this agreement. This limitation on liability shall also apply in the event that images are lost through equipment malfunction, lost in the mail or otherwise lost or damaged without fault on the part of the Photographer. In the event that the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the Photographer’s fee.
  7. Payment -The Client’s payment to the Photographer shall be as follows: A deposit of £150 is due at the signing of this agreement. The remainder of the Photographer’s fee (Package price minus deposit) is payable in full the week before your wedding day or any time before.
  8. In the event that the client cancels the contracted services for wedding photography outlined in this contract before the wedding ceremony takes place, the deposit will be forfeit. The photographer agrees to refund all additional money paid to the client within one month.
  9. Final photographs will be sent to you within 3 months.
  10. The Photographer will maintain backup copies of the images in their archive and on the website for a period of 1 year. Additional USBs can be requested at cost.
  11. The clients grant Ian Fry Photography consent to use the photographs for editorial, competition, advertising and any other purpose and in any manner, to alter the photographs without restriction; and to copyright the images. The clients hereby release Ian Fry Photography from all liability and claims in connection with the images.


Photo Booth Terms & Conditions (if Applicable)

We will arrive approximately 1 and a half hours before the service period begins to setup the booth. Provider agrees to have a The Bubble Booth operational for a minimum of 90% during this period; occasionally, operations may need to be interrupted for maintenance of the Photo Booth (changing photo paper, adjusting camera, adjusting printer, etc).
 
CLIENT OBLIGATIONS
· Good access for delivery to performance area. Provider should be informed if in case access is only through stairs. The Bubble Booth reserves the right to cancel any booking for the reason of inaccessibility to performance area. A fee will be charged for the lost hour and round trip travel.
· A smooth level surface with an area of at least 3m by 3m and a height of at least 3m for the photo booth setup.
·An electric outlet for the photo booth within 5 meters of the desired performance area.
· A covered or tented area if the event is outdoor. If in case a covered or tented area cannot be provided by the client, The Bubble Booth reserves the right at any time to deny service outdoors for reasons that might damage our equipment.
 
THE BUBBLE BOOTH OBLIGATIONS
· Provide an operational photo booth for the package booked.
· Provide unlimited prints for the duration of the indicated service period.
· Provide free design and layout for the print out with minimum of 3 photos and a maximum of 4 photos per print.
· Provide props for free.
· Provide a USB copy of the photos and an online gallery along with a Facebook Gallery
· Free transportation within the North Devon area. An additional payment for the transportation will be charged accordingly for events outside the service area.
· Deliver, install, and remove the photo booth in a timely manner.
 
MODEL RELEASE
Client agrees to, and understands the following: All guests using the photo booth hereby give to The Bubble Booth: The right and permission to copyright and use, photographic portraits or pictures of any photo booth user who may be included intact or in part, made through any and all media now or hereafter known for illustration, art, promotion, advertising, trade, or any other purpose. In addition I, hereby release, discharge and agree to save The Bubble Booth, from any liability, that may occur or be produced in the taking of said picture or in any subsequent processing thereof, as well as any publication thereof, including without limitation any claims for libel or invasion of privacy.
 
MISCELLANEOUS TERMS
If any provision of these terms shall be unlawful, void, or for any reason unenforceable under Contract Law, then that provision, or portion thereof, shall be deemed separate from the rest of this contract and shall not affect the validity and enforceability of any remaining provisions, or portions thereof. This is the entire agreement between Provider and Client relating to the subject matter herein and shall not be modified except in writing, signed by both parties. In the event of a conflict between parties, Client agrees to solve any arguments via arbitration.
